1. About These Terms

These Terms of Service (“Terms”) apply to your use of the Childs Heating & Air website and its online forms, booking tools, and related services.

Each HVAC service job is governed by its approved estimate, work order, contract, or invoice. Those documents establish the specific scope of work, pricing, payment schedule, and any job-specific conditions.

If a job-specific written agreement conflicts with these general Terms, the job-specific agreement controls, subject to applicable law.

Agreeing to these Terms does not constitute consent to receive text messages. SMS consent is addressed separately in Section 12.

2. Who We Are

Childs Heating & Air, LLC (“Childs Heating & Air,” “we,” “us,” or “our”) provides residential and light-commercial HVAC services throughout Middle Tennessee.

We provide heating, cooling, repair, maintenance, replacement, installation, and related HVAC services.

Service availability may vary based on location, scheduling, weather, and technician availability.

3. Services and Scope of Work

We perform HVAC inspections, diagnostics, repairs, maintenance, equipment replacements, installations, and related services.

Descriptions on our website are for general information. The specific work to be performed is established in the approved estimate or work agreement.

24/7 Service

We offer 24/7 service, including emergency and after-hours appointments. Response times depend on scheduling, technician availability, weather conditions, and other circumstances.

Existing Equipment and Conditions

Our responsibility is limited to the approved scope of work, subject to applicable law.

Existing HVAC equipment, ductwork, electrical components, refrigerant lines, condensate drains, and other building systems may have defects or conditions not apparent during routine inspection.

We are not responsible for pre-existing defects or unrelated equipment failures unless our work causes or contributes to the problem in a manner for which we are legally responsible.

If additional problems are discovered, we will notify the customer and recommend available corrective options.

Electrical, structural, drainage, ductwork, or other repairs outside the approved scope are not included unless separately authorized.

Customer-Supplied Equipment

We do not install customer-supplied parts or equipment. All parts and equipment are supplied by Childs Heating & Air.

Permits and Inspections

Required permits and inspections will be obtained or arranged when applicable to the approved work. Project-specific responsibilities and costs will be identified in the estimate or work agreement.

4. Estimates, Pricing, Deposits, and Payment

Estimates and Pricing

Estimates are based on information available when prepared. Hidden conditions, additional defects, or requested changes may affect the final price.

Additional work requiring an increased charge will be explained and authorized before proceeding, except for immediate protective measures where permitted by applicable law.

Service-Call Charges

A service-call or trip charge applies to service appointments.

Additional charges may apply for after-hours or emergency service.

Applicable service-call charges will be disclosed when scheduling or in the applicable work agreement.

Deposit Requirements

For jobs with a total approved price exceeding $750, Childs Heating & Air generally requires an advance payment equal to 50% of the approved job price.

When the job includes specially ordered, nonreturnable materials or equipment whose supplier cost exceeds 50% of the approved job price, the required advance payment may instead equal 100% of the cost of those materials.

These amounts are not added together. The normal required advance payment is the greater of:

  • 50% of the approved job price; or
  • 100% of the cost of approved nonreturnable special-order materials.

All deposit requirements are subject to applicable legal limitations.

Legal Restrictions and Payment Schedules

Certain residential projects in Tennessee may be subject to restrictions on advance payments or deposits.

Where such restrictions apply, the amount collected at signing will not exceed the applicable legal limit unless a valid statutory exception applies.

Any additional payments required before project completion will be established in a lawful written payment schedule approved by the customer.

No deposit will be collected before the required written agreement has been approved and signed.

Customer payment schedules will comply with applicable Tennessee law, including any required disclosures concerning the customer’s right to withhold payment until work is completed.

Special-Order Materials and Equipment

Certain parts, equipment, or materials may need to be specially ordered and may not be returnable to the supplier.

These items will be identified in the customer’s approved estimate or work agreement before ordering.

Childs Heating & Air may require payment covering 100% of the supplier cost of those materials before placing the order, but only to the extent and at the time permitted by applicable law.

Where a legally required cancellation period applies, we will not place a nonreturnable special order before that period expires unless an applicable legal exception has been properly satisfied.

Cancellation After Special-Order Materials Have Been Purchased

If a customer cancels a project after authorized nonreturnable materials have been ordered, and applicable law permits us to retain payment for those materials, the customer will remain responsible for the actual, unrecoverable cost of those items.

In exchange, Childs Heating & Air will provide the customer with the materials or equipment for which payment is retained.

  • If the materials have already arrived, they will be made available to the customer.
  • If the materials are still in transit or awaiting supplier delivery, they will be provided to the customer after they arrive.
  • We will coordinate a reasonable method for transferring the materials to the customer.
  • Any amounts recovered through supplier credits, refunds, or returns will be accounted for when determining the customer’s responsibility.

The customer will not be charged for installation labor or services that were not performed, except for other lawfully recoverable costs expressly authorized in the applicable agreement.

Statutory Cancellation Rights Take Priority

Nothing in this section overrides a customer’s legally protected cancellation or refund rights.

If a customer validly cancels a transaction under a law requiring a full refund, we will provide that refund as required by law, regardless of whether special-order materials have been purchased. The customer will not be required to accept materials in place of a legally required refund.

Final Payment

All advance payments are credited toward the approved total job price.

The remaining balance is due upon completion unless a different payment arrangement is established in writing.

Payment Methods

We accept cash, checks, credit cards, and third-party financing when available.

Third-Party Financing

Financing may be offered through independent financing providers.

Financing approval, interest rates, repayment terms, and other conditions are determined by the financing provider. Childs Heating & Air is not the lender and does not guarantee financing approval.

Changes to Approved Work

Any additional work outside the approved scope will be explained and authorized before proceeding, except when immediate action is reasonably necessary to prevent injury or property damage and is permitted by law.

Lien Rights

Contractors may have rights under Tennessee law relating to unpaid work. Any required notices concerning these rights will be provided in the applicable project documents.

5. Appointments, Cancellations, and Property Access

Appointments

Customers may request service through our website, telephone, or other available booking methods.

An online request is not a confirmed appointment until Childs Heating & Air confirms it.

Appointment Cancellations

Customers may cancel or reschedule appointments by contacting our office.

We request at least 24 hours’ notice whenever reasonably possible.

We do not impose an additional late-cancellation or missed-appointment penalty under these general Terms.

Property Access

Customers agree to provide safe, reasonable access to the equipment and work areas needed to perform the requested services.

Known hazards, unsafe conditions, aggressive animals, or access limitations should be disclosed before the appointment.

We may postpone or decline work when conditions create a reasonable safety concern.

If a technician arrives and cannot perform the service because of lack of access or unsafe conditions, the previously disclosed service-call charge may still apply.

Legal Right to Cancel Certain Purchases

Certain purchases made at a customer’s residence may qualify for a three-business-day cancellation period under applicable federal or Tennessee law.

When this right applies, Childs Heating & Air will provide the required written cancellation notices and honor valid cancellations and refunds.

Customer-requested repairs, maintenance, genuine emergencies, and other transactions may be subject to statutory exceptions.

Any legally required emergency waiver or acknowledgment will be handled through separate documentation.

Nothing in these Terms restricts the customer’s statutory cancellation rights.

6. Repair Warranty

Childs Heating & Air warrants repairs performed by our company with at least a 30-day parts-and-labor warranty. Many jobs carry longer coverage of up to 2 years or more, as listed on your invoice. Refrigerant is not covered.

Some repairs may carry longer coverage. When they do, the longer coverage period will be stated on your estimate or invoice, and that stated period applies.

The warranty period begins on the date the covered repair is completed.

What Is Covered

  • Parts installed or replaced by Childs Heating & Air as part of the approved repair.
  • Labor and workmanship associated with that repair.
  • Correction or replacement of covered defective parts or workmanship discovered within the warranty period.

Covered corrections are performed without additional parts or labor charges for the covered repair.

What Is Not Covered

  • Refrigerant, including additional or replacement refrigerant, subject to applicable law.
  • Components or systems not included in the original repair.
  • Pre-existing refrigerant leaks or leaks developing in unrelated, deteriorated, or aging components.
  • Failures caused by misuse, neglect, improper operation, or unrelated system conditions.
  • Damage or failures directly caused by unauthorized alterations or work performed by others.
  • New or unrelated equipment failures occurring after the original repair.

Refrigerant and Pre-Existing System Conditions

Refrigerant is excluded from this limited warranty.

A refrigerant leak or refrigerant loss occurring within the warranty period does not automatically establish that Childs Heating & Air caused the leak or that the loss is covered.

Existing equipment may develop leaks due to corrosion, deterioration, vibration, aging components, or other unrelated conditions.

We are not responsible under this limited warranty for refrigerant loss caused by pre-existing defects or unrelated system failures.

However, this exclusion does not eliminate our legal responsibility for losses caused by our own negligence, defective workmanship, or defective covered parts to the extent required by applicable law.

Work by Other Service Providers

Service performed by another company does not automatically void the warranty. However, failures or damage directly caused by that work are excluded.

Making a Warranty Claim

Customers should contact Childs Heating & Air within the applicable warranty period at (615) 519-8545 or mail@childshvac.com.

We will evaluate the reported issue to determine whether it involves the original covered repair.

If the issue is covered, we will correct the defective repair in accordance with this warranty.

Manufacturer Warranties

Manufacturer warranties are separate and governed by the applicable manufacturer’s terms.

Equipment Installation Warranties

Warranty terms for complete equipment installations or replacements will be established in the applicable written project agreement.

Legal Rights

Nothing in this warranty limits any rights or remedies that cannot lawfully be excluded.

We may respond to reviews and request removal of content that violates applicable law or platform rules.

Nothing in these Terms restricts customers from publishing honest reviews or exercising rights protected by consumer-review laws.

9. Limitation of Liability

Childs Heating & Air performs services with reasonable care and skill.

To the extent permitted by applicable law, we are not responsible for indirect or consequential losses resulting from website interruptions, inaccurate information supplied by customers, or events outside our reasonable control.

Nothing in these Terms excludes or limits our responsibility for negligence, personal injury, property damage caused by our work, fraud, or other liability that cannot lawfully be excluded or limited.

Any job-specific limitations will be stated in the applicable written agreement and remain subject to applicable law.

10. Indemnification

To the extent permitted by law, customers agree to indemnify Childs Heating & Air against third-party claims directly arising from unlawful misuse of our website or information knowingly provided to us that is false.

This provision does not require customers to indemnify Childs Heating & Air for the company’s own negligence or misconduct.
